Investment Projects in an Era of Turbulence – One of the Sessions on the SPILF 2022 Business Programme

The Investment Projects in an Era of Turbulence: Effective Models and Legal Protection Mechanisms session is included in the business programme of the 10th St. Petersburg International Legal Forum which will be held from 29 June to 1 July at the ExpoForum Exhibition Centre.

Despite the economic changes in Russia, the need for large-scale investment projects remains. Mechanisms for implementing such projects are evolving (concessions, public-private partnerships), but new ones are emerging and being prioritized (offset). Moreover, it is now important to maintain the sustainability of already launched long-term projects. Investment lawyers have developed tools that can be used to stabilize a deal for both private and public parties. These topics will be discussed by the experts during the session.

The discussion will focus on the specifics of mechanisms for implementing investment projects: from offset to public-private partnership agreements. Experts will discuss which contractual mechanisms become a higher priority in times of crisis and how to choose a model for project implementation in the current environment. Undoubtedly, import substitution is one of the challenges the economy faces now. For which purpose amendments are being made to the legislation and new measures of state support are being introduced. During the session, legal practitioners will discuss how to effectively combine existing contractual models and support instruments when implementing investment projects.

The panellists will also look at forms of guarantees for both private and public parties and determine which ones contribute to project sustainability.

The session will touch upon the mechanism of special circumstances and compensation upon termination of a contract. The experts will also discuss the possibility of changing the investment conditions after the conclusion of the agreement.

"The sustainability of long-term investment projects largely depends on the preparatory work before concluding an agreement (it is important to take into account on which legal foundation the deal is based) and competent legal work to implement the terms and conditions of the agreement and legislation in case circumstances change. Competent legal structuring of a project creates stable conditions for realization of investment ideas for development of the entire economy", said Evgenia Zusman, session moderator, Partner at You & Partners and Deputy Director of the Centre for Investment Analysis at the National Research University – Higher School of Economics.

For the first time in two years, the 10th St. Petersburg International Legal Forum will return to its traditional face-to-face format and will traditionally bring together leading lawyers of various specializations, public figures, opinion leaders, as well as media representatives. The main theme is Staying within the Law, while the theme of the plenary session is Law in a Multipolar World.
